    This panel will consider whether, if the US or Canadian government were to endorse some of the transfer pricing approaches recently proposed in OECD documents related to BEPS, such as those with respect to intangibles pricing, then the USA or Canada should, or would have to, make statutory or income tax treaty changes in order to implement these approaches or whether, instead, they could give legal effect to them administratively under existing statutes and treaties. The panel will also consider the legal and practical implications for transfer pricing of recent Canadian and USA developments, including the McKesson decision of the Tax Court of Canada and the 2014 IRS’ Transfer Pricing Audit Roadmap.
